Please read carefully before accessing the Nine Island Communications website (the “Site”)

BY ACCESSING AND BROWSING THE SITE, YOU ACCEPT THE TERMS AND CONDITIONS CONTAINED HEREIN.

ACCEPTANCE. This Terms of Use Agreement (the “Agreement”) is a legal agreement between you and Nine Island Productions and Consulting Inc. (“Nine Island”), the owner and operator of the Site.  This Agreement states the terms and conditions under which you may access and use the Site, and any other publicly accessed site maintained by Nine Island (the “Sites”).  By accessing and using the Site, or any of the Sites, you are indicating your acceptance to be bound by the terms and conditions of this Agreement.  If you do not accept the terms and conditions of this Agreement, you must not access or use the Site, or any of the Sites.  Nine Island may revise this Agreement at any time by updating this posting.  Use of the Sites after such changes are posted will signify your acceptance of these revised terms.  You should visit this page periodically to review this Agreement

Use of the Sites

In order to use the Sites, you may be required to provide information about yourself, including your name, e-mail address, and other personal information.  You agree that any registration information you give to Nine Island will always be accurate, correct, and up to date.  You shall only be allowed to provide your own personal information and not the information of others.

Rights in the Sites and Site Content

The Sites and all content provided on the Sites are protected by copyright, trademark, and other applicable intellectual property and proprietary rights laws, and is owned, controlled, and/or licensed by Nine Island and/or its affiliates and related companies.  Nothing contained on the Sites should be considered as granting, conveying or creating any licence or right to use any such intellectual property, including, but not limited to, marks identifying Nine Island and/or its affiliates and related companies or their respective products and services, without the expressed written consent of Nine Island or such third party that may own such intellectual property displayed on the Sites.

Unless expressly provided otherwise by Nine Island, all comments, feedback, information, or materials submitted to Nine Island through or in association with the Sites shall be considered non-confidential and Nine Island’s property.  By submitting such comments, feedback, information, or materials to Nine Island, you agree to a no-charge assignment to Nine Island of all worldwide rights, title, and interest in copyrights and other intellectual property rights to the comments, feedback, information, or materials.  Nine Island shall be free to use, copy, or distribute such comments, feedback, information, or materials on an unrestricted basis without accounting to you.

The content on the Sites is protected by Canadian and foreign copyright laws.  Any use of the content not expressly permitted in this Agreement is a breach and may violate copyright and other laws.  Any copyright or other legal infringement may result in legal action taken on behalf of Nine Island.

Privacy

Nine Island will treat any personal information you submit through the Sites in accordance with its Privacy Policy.  Please click here and review our Privacy Policy, as such may be amended from time to time.  Nine Island advises you to check this Privacy Policy regularly for changes.  You hereby consent to the use of your Personal Information (as defined in the Personal Information and Electronic Documents Act, Canada) in accordance with the terms and for the limited purposes set forth in our Privacy Policy.

No Warranties/Limitation of Liability

Nine Island does not warrant the quality, accuracy, or completeness of any information on our Sites.  Such information and the Sites are provided “as is” and “as available” without warranty or condition of any kind.  The Sites may include inaccuracies or typographical errors.  In no event shall Nine Island be liable for any damages whatsoever, including direct, special, indirect, punitive, or consequential damages, arising out of or in connection with the use or performance of information available on the Sites, regardless of the cause.

No Endorsement

No endorsement of any third party products or services in expressed or implied by any information, material, or content referred to or included on, or linked from or to the Sites.

Amendments and Jurisdiction

Nine Island retains the right to amend the above conditions at any time, including the right to revoke any permissions.

The Sites are operated from the Province of Newfoundland and Labrador, Canada.  By accessing the Sites you agree that your actions shall be governed by the laws of the Province of Newfoundland and Labrador and the federal laws of Canada, without regard to conflict of laws principles.  You agree and hereby submit to the non-exclusive jurisdiction of the courts of the Province of Newfoundland and Labrador with respect to all matters arising from this Agreement.

Nine Island either owns the intellectual property rights in the underlying HTML, Java scripts, text, audio clips, video clips, and other content that is made available to you on the Sites, or had obtained the permission of the owner of the intellectual property in such content to use the content on the Sites.

Limited Licence

Nine Island grants you a limited licence to display on your computer print, download, and use the underlying HTML, text, audio clips, video clips, and other content that is made available to you on our Sites for non-commercial, personal, or educational purposes only, provided that:

  1. you do not modify any such content; and
  2. you include with and display on each copy of such content the associated copyright notice and this limited licence.

No other use is permitted.  Without limiting the generality of the foregoing, you may not:

  1. make any commercial use of such content;
  2. include such content in or with any product that you create or distribute; or
  3. copy such content onto your or any other website.

Notwithstanding the above, nothing contained in this licence shall be construed as conferring any right under any copyright of Nine Island or any other person who owns the copyright in content provided on our website.
